Terms of Services – Cashai

Welcome to Cashai, the mobile lending platform owned and operated by G.A. OROBIA LENDING CORP.. These Terms of Service ("Terms") govern your access to and use of our application ("App") and related financial services. By using Cashai, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree, you must stop using the App.

1. Definitions

- Cashai: The mobile lending service provided by the Company, which offers short-term consumer loans to eligible borrowers in the Philippines.

- User: Any individual who downloads, registers, or uses the App or its services.

- We / Us / Company: Refers to G.A. OROBIA LENDING CORP., the licensed lending corporation operating Cashai.

2. Scope of Services

Through Cashai, Users can:

- Create and manage digital accounts with identity authentication

- Apply for loans, which undergo review and approval processes

- Receive funds and track repayment schedules

- Receive reminders and customer support assistance, including handling of feedback or complaints

3. Eligibility

To use Cashai, you must:

- Be at least 18 years old and legally capable of entering into contracts

- Be a Philippine resident and present a valid government-issued ID

- Provide complete and accurate personal and financial details

- Have sufficient financial ability to meet repayment obligations

4. User Responsibilities

By using Cashai, you agree to:

- Provide only truthful, current, and complete information

- Follow all applicable laws and these Terms

- Repay any loan obtained on or before the agreed due date

- Avoid misuse of the App for unlawful, deceptive, or fraudulent activity

Violation of these responsibilities may result in restricted access, suspension, or legal action.

5. Accuracy of Information

You are responsible for ensuring all information you provide remains correct and up to date. False, misleading, or outdated information may lead to rejection of applications, account deactivation, or further measures as required by law.

6. Loan Repayment

Borrowers must fulfill repayment obligations according to the agreed loan terms. Failure to do so may:

- Result in additional charges or late payment fees

- Negatively affect your credit reputation

- Lead to collection actions as permitted under Philippine law

Paying on time strengthens your borrowing profile and improves future loan eligibility.

7. Prohibited Activities

The App must not be used for:

- Fraud, impersonation, or identity theft

- Money laundering or other unlawful activities

- Any purpose outside the intended scope of Cashai's services

Suspicious or prohibited use will result in immediate account suspension and may be reported to regulatory authorities.

8. Account Security

You are responsible for safeguarding your login details. Do not share your credentials with others. Notify us immediately of any unauthorized use or unusual activity on your account. We are not responsible for losses resulting from compromised accounts caused by User negligence.

9. Loan Terms

- Loan Amounts: Determined by your credit profile and eligibility

- Duration: Clearly specified in the approved loan offer

- Interest & Fees: Fully disclosed before loan acceptance

- Repayment Options: Payments may be made through banks, e-wallets, or other authorized channels

10. Data Privacy

Cashai is committed to protecting your personal data in line with the Philippine Data Privacy Act of 2012.

- Information is collected only for service delivery, identity verification, loan processing, and compliance purposes

- All data is transferred over secure HTTPS connections (https://check.Cashai.net/) and safeguarded by advanced encryption standards

- We will never disclose your data for marketing or profit without your consent, except when required by law

11. Intellectual Property

All rights to Cashai's software, design, content, and trademarks belong to the Company. No User may reproduce, alter, or distribute any part of the App without prior written authorization.

- Natural calamities or other force majeure events

- Technical or system errors beyond our control

Users remain responsible for the consequences of their own actions when using the App.

13. Suspension & Termination

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of the Philippines. Any dispute shall first be settled through negotiation. If unresolved, disputes shall be referred to the competent courts of Manila, Philippines

15. Amendments

The Company may update these Terms from time to time. Any revisions will be communicated through the App or other official channels. Your continued use of Cashai after such changes constitutes acceptance of the updated Terms.
